When a loved one dies as a result of an error by a negligent third party, the loss can be unbearable. The families and friends of a victim often find it extremely difficult to function in their daily lives. Grieving can be debilitating, as can the feelings of helplessness and frustration. The family of the victim may feel that they do not have the energy to pursue legal action for compensation against the driver responsible.

As part of the Administration of Justice Act 1982, claims can be brought by dependants of an individual who dies as a result of any wrongful act, neglect or default of another party. Compensation gained from successful legal action will in no way replace the loss of a loved one, but it can ease the stress of financial difficulties.

The Act covers dependants who are defined as dependent children, a spouse or common law spouse and other dependants who had a relationship with the deceased. The last group must show that they had suffered a financial loss or would in the future, as a result of the death.

If a claim is successful, damages for funeral arrangements and a Statutory Sum for Bereavement can be received. Loss of dependency from the deceased earnings and pension can also be claimed but these amounts are often difficult to calculate. The estimated joint income of the husband and wife needs to include a dependency fraction, and then the resulting income of the living spouse is subtracted. These calculations can vary, but a specialist lawyer will handle all the processes involved.

A fall from height is the most common cause of a fatal accident claim while the next most frequent is involvement in an RTA. Statistics show that the majority of fatalities occur in the workplace; especially within the construction and agriculture industries.

This free legal networking service is designed to ensure that anyone needing to see a solicitor can access advice from a qualified specialist.
